ಮಧ್ಯಸ್ಥಿಕೆ ಪ್ರಕ್ರಿಯೆಯಲ್ಲಿ ಹೇಳಿಕೆ ಸಲ್ಲಿಸುವ ಮುನ್ನ ಅದಕ್ಕೆ ಸಹಿ ಮಾಡಿದ ಪಾಲುದಾರ ಮೃತಪಟ್ಟಿದ್ದರೂ, ಉಳಿದ ಪಾಲುದಾರರು ಜೀವಂತವಾಗಿದ್ದು ಪ್ರಕರಣವನ್ನು ಪಾಲುದಾರಿಕೆ ಸಂಸ್ಥೆಯ ಹೆಸರಿನಲ್ಲಿ ಮುಂದುವರಿಸುತ್ತಿದ್ದರೆ, ಕೇವಲ ಆ ಪಾಲುದಾರನ ಮರಣದ ಕಾರಣಕ್ಕೆ ಮಧ್ಯಸ್ಥಿಕೆ ಪ್ರಕ್ರಿಯೆ ರದ್ದಾಗುವುದಿಲ್ಲ ಎಂದು ಅಲಹಾಬಾದ್ ಹೈಕೋರ್ಟ್ ತೀರ್ಪು ನೀಡಿದೆ.

ಕಾನೂನುಬದ್ಧ ಬಂಧನ ಪ್ರಕ್ರಿಯೆಯನ್ನು ಪಾಲಿಸದೆ ವ್ಯಕ್ತಿಯೊಬ್ಬರನ್ನು ಐದು ದಿನಗಳ ಕಾಲ ಪೊಲೀಸ್ ವಶದಲ್ಲಿಟ್ಟಿದ್ದಕ್ಕಾಗಿ ಉತ್ತರ ಪ್ರದೇಶ ಸರ್ಕಾರವು ದಿನಕ್ಕೆ ₹25,000ರಂತೆ ಒಟ್ಟು ₹1.25 ಲಕ್ಷ ಪರಿಹಾರ ಪಾವತಿಸಬೇಕು ಎಂದು ಅಲಹಾಬಾದ್ ಹೈಕೋರ್ಟ್ ಆದೇಶಿಸಿದೆ.
ಮಾರಾಟ ಒಪ್ಪಂದ ಉಲ್ಲಂಘನೆಯಾದ ಮಾತ್ರಕ್ಕೆ ಮುಂಗಡ ಹಣವನ್ನು ಮುಟ್ಟುಗೋಲು ಹಾಕಿಕೊಳ್ಳುವಂತಿಲ್ಲ: ನಷ್ಟವನ್ನು ಸಾಬೀತುಪಡಿಸುವುದು ಮಾರಾಟಗಾರನ ಜವಾಬ್ದಾರಿ – ದೆಹಲಿ ಹೈಕೋರ್ಟ್
ಮಾರಾಟ ಒಪ್ಪಂದದಡಿ ಖರೀದಿದಾರನು ಒಪ್ಪಂದ ಪಾಲಿಸದಿದ್ದರೂ, ಮಾರಾಟಗಾರನು ಮುಂಗಡ ಹಣವನ್ನು ಮುಟ್ಟುಗೋಲು ಹಾಕಿಕೊಳ್ಳಲು ಒಪ್ಪಂದ ಉಲ್ಲಂಘನೆಯಿಂದ ತನಗೆ ಉಂಟಾದ ಕಾನೂನುಬದ್ಧ ನಷ್ಟವನ್ನು ಸಾಬೀತುಪಡಿಸಬೇಕು ಎಂದು ದೆಹಲಿ ಹೈಕೋರ್ಟ್ ತೀರ್ಪು ನೀಡಿದೆ.
